It used to be that when a real estate agent would work with a buyer, that buyer automatically assumed that the agent was working in his or her best interests.  And why not?  The agent would spend hours, weeks and sometimes even months working with them.  In the course of all this time together, confidential information regarding the buyer's private finances, family matters and more would often be disclosed to the agent.  Why would the buyer think for even a second that the agent was not solely on THEIR side?  The truth, however, was that until recently, the buyer rarely knew that by law the agent always represented the SELLER in any transaction.  Theoretically, the agent was obligated to share any useful information that was disclosed by the buyer to the SELLER and to negotiate in the SELLER'S best interests. 

But, eventually, the Real Estate Commission realized that this situation not only created a big conflict of interest for agents, but more importantly it left buyers without any representation.  So they created the free Buyer Agency relationship.
